We have published feedback from our conflicts of interest thematic examination. The thematic examination focussed on compliance with obligations in relation to the:
- adequacy of policies and procedures for identifying and managing conflicts of interest
- accuracy of the records maintained
- firm’s understanding of conflict risk in their business
- board’s oversight of the compliance function and the effectiveness of managing conflict risk
- independence of key persons
- staff awareness of their responsibilities to disclose and manage conflicts of interest
Inadequate systems for identifying and managing conflicts of interest increase the likelihood that personal interests may influence professional judgment. This can result in regulatory breaches, reputational harm, and adverse customer outcomes.
